Terms & Conditions

These Terms & Conditions govern your access to and use of the ROOTÉ website, applications, hair-analysis services, questionnaires, personalized programs, digital content, products, subscriptions, communications, and related services. ROOTÉ is operated by 91 ENTERPRISE LLC.

  1. 01Acceptance of These Terms

    Welcome to ROOTÉ. These Terms & Conditions (“Terms”) govern your access to and use of the ROOTÉ website, applications, hair-analysis services, questionnaires, personalized programs, digital content, products, subscriptions, communications, and related services (collectively, the “Services”). ROOTÉ is operated by 91 ENTERPRISE LLC (“ROOTÉ,” “Company,” “we,” “us,” or “our”).

    By accessing the Services, creating an account, completing a hair assessment, purchasing a product or program, or otherwise using ROOTÉ, you agree to these Terms and to our Privacy Policy and other policies referenced herein. If you do not agree, you should not use the Services.

    Nothing in these Terms limits any mandatory consumer right or legal protection that cannot lawfully be waived or excluded.

  2. 02Eligibility

    The ROOTÉ Services are intended for individuals who are at least 18 years old, unless we expressly state otherwise. By using the Services, you confirm that:

    • you are legally capable of entering into a binding agreement
    • the information you provide is accurate to the best of your knowledge
    • and you will use ROOTÉ products and services only in accordance with applicable instructions

    ROOTÉ may require age or identity verification where reasonably necessary.

  3. 03ROOTÉ Is a Personalized Hair System

    ROOTÉ may provide services including:

    • hair and scalp questionnaires
    • guided photography
    • AI-assisted hair analysis
    • personalized hair reports
    • consumer product recommendations
    • personalized routines and programs
    • progress photography
    • before-and-after comparisons
    • reminders
    • educational information
    • customer-support or AI-coach functionality
    • product sales
    • subscriptions or recurring programs
    • and, where separately offered, access to licensed healthcare professionals

    The availability of features and products may vary according to the user's location, applicable law, age, medical eligibility, inventory, product classification and other factors.

  4. 04AI Hair Analysis

    ROOTÉ may use artificial-intelligence systems, computer-vision systems and third-party technology providers, including HairHealth.ai where enabled, to analyze photographs and information submitted by users. AI analysis may evaluate characteristics such as visible hair coverage, thinning patterns, hairline characteristics, scalp visibility, density-related indicators, or other supported parameters.

    AI analysis is subject to limitations. Results may be affected by:

    • image quality
    • lighting
    • camera position
    • hair length
    • hair style
    • hair color
    • scalp visibility
    • previous procedures
    • technical limitations
    • the information supplied by the user
    • and limitations inherent in the AI model

    AI results may be incomplete, inaccurate or unsuitable for making a medical determination. ROOTÉ does not guarantee the accuracy of any AI-generated result.

  5. 05AI Analysis Is Not Automatically a Medical Diagnosis

    Unless a result has been separately reviewed and issued by an appropriately licensed healthcare professional, a ROOTÉ hair analysis, AI report, questionnaire result, automated recommendation or consumer-facing Hair Score does not constitute a medical diagnosis, does not constitute medical advice, and is not a substitute for consultation with a qualified physician or other appropriate healthcare professional.

    If you experience sudden hair loss, patchy hair loss, scalp lesions, significant pain, severe irritation, unexplained symptoms or another medical concern, you should seek professional medical evaluation.

  6. 06Health and Product Responsibility

    You are responsible for reviewing the label, ingredients, warnings, instructions, contraindications and directions provided with any ROOTÉ product. Products should be used only as directed.

    Before starting any product or program, you should consult a physician or other appropriately qualified healthcare professional if you:

    • have an existing medical condition
    • take prescription or non-prescription medications
    • have allergies or known sensitivities
    • have experienced previous adverse reactions
    • are pregnant, breastfeeding or trying to conceive
    • are undergoing another hair-loss treatment
    • have undergone a hair transplant or medical procedure
    • or otherwise have reason to question whether a product is suitable for you

    The fact that a ROOTÉ website, questionnaire, algorithm or AI system recommends or displays a product does not by itself establish that the product is medically appropriate for you. By choosing to use a ROOTÉ product, you acknowledge that you are responsible for reviewing whether the product is appropriate for your personal circumstances and for obtaining advice from an appropriately qualified physician or other healthcare professional when your health condition, medication use, allergies, sensitivities, pregnancy or breastfeeding status, prior reactions, or other relevant circumstances may affect suitability. Use of a non-prescription product remains your responsibility, subject to mandatory rights and protections that cannot lawfully be waived. ROOTÉ does not act as your personal physician and does not assume responsibility for individual medical outcomes merely because a product, program, report, or AI-generated recommendation is displayed, recommended, sold, or purchased. To the fullest extent permitted by applicable law, ROOTÉ is not responsible for harm resulting from misuse, use contrary to instructions, use despite a known contraindication, failure to obtain appropriate professional advice where reasonably indicated, failure to provide relevant safety information when requested, or continued use after a significant adverse reaction. Nothing in these Terms excludes liability for defective products, negligence, fraud, willful misconduct, personal injury, or any other liability or consumer right that applicable law does not permit to be excluded or limited.

  7. 07Individual Results — No Guarantee

    Hair biology and response to treatment differ between individuals. Results may depend on numerous factors including genetics, age, cause of hair loss, duration of hair loss, adherence, health, medication use, lifestyle, product tolerance and other individual factors.

    ROOTÉ does not guarantee:

    • hair regrowth
    • prevention of future hair loss
    • restoration of pigmentation
    • a specific increase in density
    • a particular Hair Score
    • a specific percentage of improvement
    • or results within a particular period

    unless an express claim is specifically made and is lawfully supported by appropriate evidence. Past customer experiences and before-and-after photographs do not guarantee that another customer will receive the same result.

  8. 08Adverse Reactions

    Some products may cause irritation, allergic reactions, intolerance or other adverse effects. Stop using a product and seek appropriate professional advice if you experience an unexpected or concerning reaction. For urgent or serious symptoms, seek immediate medical attention. ROOTÉ's customer service or AI systems should not be used as emergency medical services.

  9. 09Prescription and Clinician-Reviewed Products

    Certain products or treatments may require a prescription, licensed-provider review or other medical approval depending on the product and customer's jurisdiction. Where such a requirement applies:

    • a consumer AI recommendation does not constitute approval
    • a purchase may remain pending until appropriate approval is received
    • a licensed healthcare professional has independent responsibility for clinical decisions
    • and ROOTÉ may refuse, change or cancel a proposed treatment if legal or clinical requirements are not satisfied

    Clinical services may be provided by independent licensed providers or medical organizations subject to separate clinical terms, privacy notices and informed-consent documentation. ROOTÉ will not instruct a user to bypass a prescription requirement.

  10. 10Product Information

    We attempt to present product information accurately. However, packaging, ingredient appearance, photographs and non-material presentation may change. The product label and product-specific instructions supplied with the product should be reviewed before use. Where there is a conflict between general website content and legally required product labeling or clinician instructions, the legally required labeling or clinician instructions control.

  11. 11Orders

    An order is an offer by you to purchase the applicable products or services. ROOTÉ may accept or reject an order for legitimate reasons including:

    • inventory availability
    • payment failure
    • suspected fraud
    • pricing or technical errors
    • shipping limitations
    • regulatory restrictions
    • medical eligibility requirements
    • or inability to lawfully supply the product in the customer's jurisdiction

    An order is not finally accepted until confirmed by ROOTÉ.

  12. 12Pricing

    Prices displayed at checkout will govern the applicable transaction, subject to correction of obvious errors where permitted by law. Applicable taxes, shipping charges, customs duties and other mandatory fees will be disclosed as required by applicable law. For Israeli consumers, prices and mandatory charges will be presented in accordance with applicable Israeli consumer law.

  13. 13Payment

    Payments may be processed by independent payment processors. ROOTÉ does not intentionally store complete payment-card numbers or card security codes on its own systems. Payment providers may process payment information according to their own privacy and security terms.

  14. 14Programs and Program Durations

    ROOTÉ may offer structured programs such as:

    • 90-Day Program
    • 120-Day Program
    • 180-Day Program
    • 270-Day Program
    • and 360-Day Program

    The recommended program duration does not guarantee that a specific result will occur within that timeframe. Program duration may represent the intended period of use, monitoring, delivery or engagement rather than a guarantee of biological outcome.

  15. 15Subscriptions and Recurring Billing

    Some ROOTÉ programs may involve recurring billing or recurring shipments. Before a recurring purchase is completed, ROOTÉ will display the applicable:

    • initial charge
    • renewal amount
    • billing frequency
    • delivery frequency
    • program duration
    • automatic-renewal terms, if any
    • and available cancellation methods

    ROOTÉ will not intentionally conceal a recurring charge within a one-time purchase. Where applicable law requires affirmative consent for recurring billing or renewal, ROOTÉ will obtain such consent. Customers may cancel recurring services using the methods disclosed at purchase and in accordance with mandatory applicable consumer law.

  16. 16Account Responsibility

    You are responsible for maintaining the security of your account credentials. You must not intentionally provide another person's photographs, health information or personal information without authorization. Notify ROOTÉ promptly if you believe your account has been compromised.

  17. 17Progress Tracking

    ROOTÉ may allow users to store repeat photographs and compare them with previous images. Differences in photographs do not necessarily represent actual biological change. Lighting, angle, hairstyle, camera distance, haircut and other conditions can affect perceived results. ROOTÉ may suppress, qualify or refuse to display a quantitative comparison where there is insufficient measurement confidence.

  18. 18Intellectual Property

    The ROOTÉ name, brand, logo, website design, software, content, reports, graphics, videos, algorithms, documentation and other proprietary materials are owned by or licensed to ROOTÉ and are protected by applicable intellectual-property laws. No ROOTÉ materials may be copied, commercially exploited, reproduced or redistributed except as expressly permitted. Users may retain personal copies of reports generated for their own use.

  19. 19Customer Photographs and Content

    You retain your applicable rights in photographs and information you upload. You grant ROOTÉ a limited right to process such material solely as necessary to provide the Services and for any additional purpose to which you have separately agreed. ROOTÉ will not use identifiable customer scalp or hair photographs for advertising or AI-model training without additional authorization where such authorization is required or promised. A separate release must be obtained before using customer photographs in marketing, testimonials or public before-and-after materials.

  20. 20Reviews and Testimonials

    If you voluntarily submit a review or testimonial, ROOTÉ may request permission to publish it. ROOTÉ will not intentionally represent an incentivized or paid endorsement as an independent testimonial. Any required disclosure regarding incentives will be provided.

  21. 21Prohibited Use

    You may not use the Services to:

    • commit fraud
    • impersonate another person
    • upload content you are not authorized to provide
    • interfere with website security
    • reverse engineer protected software except where law expressly permits
    • misuse prescription or regulated products
    • resell products where prohibited
    • or use ROOTÉ for unlawful purposes
  22. 22Third-Party Services

    ROOTÉ may use third-party companies for services including AI analysis, hosting, payment processing, CRM, communications, email, analytics, shipping, fulfillment, customer support, and medical services. ROOTÉ is not responsible for independent services outside its reasonable control, subject always to any responsibilities imposed on ROOTÉ by applicable law.

  23. 23Service Availability

    ROOTÉ does not guarantee uninterrupted availability. The Services may occasionally be unavailable due to maintenance, provider outages, updates, internet failures, cybersecurity events or other circumstances. We may modify or discontinue non-purchased features at reasonable discretion. Any rights relating to already-purchased products or services remain subject to applicable law and the terms applicable at purchase.

  24. 24Limitation of Liability

    Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. This includes any mandatory consumer rights and other liabilities that applicable law requires to remain enforceable.

    To the fullest extent permitted by applicable law, ROOTÉ will not be responsible for loss or harm resulting from:

    • use of a product contrary to its instructions
    • intentional misuse
    • use despite a known contraindication
    • failure to provide relevant information when expressly requested for safety purposes
    • continued use after a significant adverse reaction
    • unauthorized combination of products contrary to instructions
    • unauthorized account access caused by the user's failure to reasonably protect credentials
    • or reliance on an AI assessment as a substitute for necessary professional medical care

    ROOTÉ does not exclude responsibility for defective products, fraud, willful misconduct, gross negligence or personal injury where applicable law prohibits such exclusion. To the fullest extent legally permitted, liability for other claims arising from a specific commercial transaction shall not exceed the amount paid by the customer for the product or service giving rise to that claim.

  25. 25Israeli Consumers

    If you are a consumer in Israel, your mandatory rights under Israeli law apply notwithstanding any conflicting provision in these Terms. Nothing in these Terms is intended to waive or restrict a statutory right that Israeli law does not permit a consumer to waive. This includes applicable rights relating to:

    • distance-sales transactions
    • required disclosures
    • cancellation
    • refunds
    • defective or non-conforming goods
    • pricing
    • marketing communications
    • privacy
    • and methods for terminating ongoing transactions

  26. 26Governing Law

    Subject to mandatory consumer laws that apply based on your place of residence, these Terms are governed by the laws applicable to 91 ENTERPRISE LLC's U.S. operations and the State of California, without unnecessarily depriving consumers of mandatory protections applicable in their jurisdiction. For business/non-consumer disputes, courts located in Los Angeles County, California may have jurisdiction. Consumers retain any non-waivable jurisdictional rights available under applicable law.

  27. 27Changes to Terms

    ROOTÉ may update these Terms from time to time. Material changes will be communicated where required by law. Changes do not retroactively deprive customers of rights associated with completed transactions. The current effective date will appear at the top of this document.
