Subscription & Automatic Renewal Terms

These Subscription & Automatic Renewal Terms explain how recurring ROOTÉ programs, automatic reorders, renewal charges, reminders, price changes, pauses and cancellations work. These Terms supplement the ROOTÉ Terms & Conditions, Privacy Policy, Shipping, Returns & Cancellation Policy, and any product-specific terms shown at checkout.

  1. 01Subscription Is Optional

    A ROOTÉ subscription or recurring order begins only if you affirmatively choose a recurring option. Purchasing a ROOTÉ product, completing a hair analysis, creating an account, or receiving a personalized program does not automatically enroll you in a subscription. ROOTÉ will not intentionally enroll a customer into recurring billing through:

    • a pre-checked box
    • hidden terms
    • silence
    • inactivity
    • or failure to opt out

    Where applicable law requires express affirmative consent, ROOTÉ will obtain such consent before recurring billing begins.

  2. 02What Recurs

    If you choose a recurring ROOTÉ program, the applicable products and/or program components may be automatically reordered and shipped at the end of each supply period. Depending on the program selected, recurring services may include:

    • treatment products
    • supplements
    • hair-care products
    • program access
    • progress tracking
    • app features
    • follow-up hair analysis
    • or other services disclosed before purchase

    The exact contents of your recurring order will be shown before you subscribe.

  3. 03Program Duration vs Subscription

    ROOTÉ may offer program durations such as 90, 120, 180, 270 or 360 Days. A program duration and an automatic subscription are not necessarily the same thing. For example, a 180-Day Program may mean a six-month treatment plan — it does not automatically mean that the program renews after 180 days unless the customer expressly agrees to automatic renewal. The checkout page must clearly state whether the selected program is a one-time purchase or an automatically renewing subscription before payment is submitted.

  4. 04Billing Cycle

    If you subscribe, you will be charged according to the billing frequency disclosed at checkout — for example, every 30, 60 or 90 days, or another clearly disclosed interval. Before you confirm the subscription, ROOTÉ will display:

    • the amount due today
    • the recurring amount
    • the billing frequency
    • the shipment frequency
    • the next estimated billing date
    • and how to cancel
  5. 05When We Charge You

    Recurring charges are generally processed shortly before or when the applicable recurring order is prepared for fulfillment. The exact billing schedule shown in your account and/or at checkout will control. ROOTÉ will not intentionally charge a recurring payment earlier than the disclosed billing schedule except where the customer has expressly agreed to a change or applicable law otherwise permits it.

  6. 06Renewal Price

    Unless otherwise expressly stated, your renewal price will be the recurring price disclosed to you when you enrolled, subject to any later price change made in accordance with these Terms and applicable law. ROOTÉ will not silently replace the agreed recurring price with a different price. Any taxes, shipping or legally applicable fees will be handled as disclosed at checkout or in the applicable renewal notice.

  7. 07Automatic Renewal

    If your plan is designated as automatically renewing, it will continue until cancelled unless a fixed termination date has been expressly stated. Before subscription enrollment, ROOTÉ will clearly disclose that your payment method may be charged automatically unless you cancel, and that the subscription may continue for successive billing periods unless cancelled.

  8. 08Affirmative Consent

    By activating a recurring plan, you specifically authorize ROOTÉ and its payment processor to charge your selected payment method for recurring amounts according to the disclosed billing schedule. Your authorization continues until the subscription is cancelled or otherwise terminated. ROOTÉ may retain appropriate records evidencing the customer's affirmative consent to recurring billing.

  9. 09Confirmation After Subscription

    After you enroll, ROOTÉ will send or otherwise make available a confirmation containing the material subscription terms, including:

    • product/program
    • recurring price
    • billing frequency
    • shipment frequency
    • renewal terms
    • and cancellation instructions

    The confirmation will be provided in a form that the customer can retain.

  10. 10Renewal Reminders

    ROOTÉ may send reminder notices before upcoming renewals, and will provide renewal notices when required by applicable law. Where ROOTÉ sends an operational pre-renewal reminder for a standard recurring order, it may be sent several days before the recurring charge and will identify the upcoming billing information available at that time, showing the upcoming order, billing date, amount and products, along with options to manage, pause, skip or cancel. This is not only legally safer; it will reduce chargebacks and complaints.

  11. 11California Renewal Notices

    For customers protected by California's Automatic Renewal Law, ROOTÉ will provide notices required by applicable California law. Current California rules include, where applicable:

    • express affirmative consent before recurring billing
    • an annual subscription reminder
    • advance notice for automatically renewing arrangements with an initial term of one year or longer
    • notices relating to certain free or discounted trial conversions
    • advance notice for qualifying price changes
    • and simple cancellation mechanisms

    For annual or longer auto-renewing plans, California currently requires renewal notice generally 15 to 45 days before renewal, where the statutory rule applies. ROOTÉ will follow the specific requirements applicable to the customer's subscription.

  12. 12Annual Reminder

    Where required by California law or other applicable law, ROOTÉ will send an annual reminder concerning active automatically renewing subscriptions. The reminder should include the name of the subscription, amount charged, billing frequency, and how to cancel. California's current Automatic Renewal Law requires an annual reminder for covered automatic-renewal and continuous-service plans.

  13. 13Price Changes

    ROOTÉ may change subscription prices in the future. A price change will not be applied without advance notice where required by applicable law. The notice will identify the new price, when it takes effect, and how to cancel. Where applicable law requires additional affirmative consent to a price change, ROOTÉ will obtain that consent before the changed fee takes effect. For California customers, applicable rules currently include specific notice timing in connection with qualifying fee changes.

  14. 14No Retroactive Price Changes

    A new recurring price will not retroactively change charges that have already been properly processed. If ROOTÉ changes pricing, the new price applies only to future qualifying billing periods, subject to required notice and consent.

  15. 15Pausing

    Where available, customers may temporarily pause their subscription. A pause may stop the next shipment, the next charge, or both, as displayed in the customer's account. The length and effect of a pause will be shown before confirmation. ROOTÉ clearly distinguishes pausing a subscription from cancelling it, so the customer understands the difference.

  16. 16Skipping an Order

    Where available, customers may skip an upcoming shipment. Skipping one shipment does not automatically cancel the entire subscription. Before confirming a skip, ROOTÉ displays the next scheduled shipment and charge date where available.

  17. 17Changing Delivery Frequency

    Where supported, customers may change their delivery interval through the ROOTÉ account. Any resulting changes to price or shipment quantity are displayed before the customer confirms the change.

  18. 18How to Cancel

    Customers may cancel future recurring billing online (Account → Subscription → Cancel Subscription), by email at support@roote.us, or by telephone at +1 (310) 651-7283, and through any additional cancellation method required by applicable law. For customers who enrolled online, ROOTÉ provides an online cancellation option where required by applicable law, and does not require speaking to a retention representative merely to submit the cancellation. California law currently requires online cancellation for subscriptions accepted online and prohibits unnecessary steps that obstruct or delay cancellation.

  19. 19Israeli Cancellation Methods

    For Israeli consumers, where the transaction qualifies as an ongoing/continuous transaction under Israeli consumer law, ROOTÉ will provide the cancellation methods required by applicable law, including telephone, email, registered mail and, where the transaction can be entered into online, an internet cancellation method.

    Where required by applicable law, ROOTÉ provides a clear online link or mechanism labeled Cancel Subscription / ביטול מנוי, and, where appropriate, Cancel Transaction / ביטול עסקה. Where required, the online cancellation mechanism is reasonably prominent and accessible.

  20. 20Effective Date of Cancellation for Israeli Consumers

    Where Israeli law governing ongoing transactions applies, a cancellation generally takes effect within three business days from receipt of the cancellation notice, or within six business days where the notice is sent by registered mail, unless the consumer specifies a later date. After the effective cancellation date, the business must stop supplying and charging for goods or services supplied thereafter. ROOTÉ will comply with those requirements where applicable.

  21. 21No Unnecessary Cancellation Friction

    ROOTÉ will not intentionally require a customer to explain why they are cancelling, complete a survey, speak with a salesperson, accept a discount, or complete unnecessary steps before a cancellation request can be submitted. ROOTÉ may optionally offer alternatives such as pausing or skipping, but such alternatives do not prevent or materially delay cancellation.

  22. 22What Cancellation Stops

    Once subscription cancellation becomes effective, it stops applicable future recurring charges and future recurring shipments. Cancellation does not automatically reverse a charge that was already lawfully processed before cancellation became effective. Any statutory cancellation or refund right relating to an already processed order remains unaffected.

  23. 23Already-Processed Orders

    If an order has already entered fulfillment when the customer cancels the subscription, that order may still ship where permitted by applicable law. The Shipping, Returns & Cancellation Policy will govern any applicable cancellation or return rights relating to that order. The subscription itself will not continue to generate future orders after cancellation takes effect.

  24. 24Cancellation Does Not Delete Your ROOTÉ Account

    Cancelling a subscription does not automatically delete the ROOTÉ account, hair-analysis results, progress photographs, personalized reports, purchase history, or app data. Privacy deletion requests are separate and are governed by the ROOTÉ Privacy Policy.

  25. 25Re-Subscription

    A former subscriber may be able to start a new subscription later. The price, product and terms available at the time of re-subscription may differ from those of the previous subscription.

  26. 26Failed Payments

    If a recurring payment fails, ROOTÉ may retry the payment, ask the customer to update the payment method, temporarily pause fulfillment, or suspend/cancel the subscription. ROOTÉ will not intentionally retry a payment method in an unreasonable manner. Any payment retry schedule is subject to payment-provider requirements and applicable law.

  27. 27Expired or Updated Payment Cards

    Payment processors may participate in card-account updater programs that allow updated card credentials to be provided by card networks. Where used, recurring billing may continue using updated payment credentials unless the subscription has been cancelled. If ROOTÉ's payment setup uses card-account updater services, this section serves as notice that updated credentials may be used for continuing authorized recurring billing until cancellation.

  28. 28Discounts and Introductory Offers

    If a subscription starts with a discount, promotional price, free trial, or introductory period, ROOTÉ will clearly disclose the introductory price, how long it lasts, the regular recurring price, when the regular price begins, and how to cancel. For California customers, certain free or discounted periods longer than 31 days require an advance reminder before conversion under current law.

  29. 29Promotional Discounts Do Not Necessarily Continue Forever

    Unless ROOTÉ expressly states otherwise, a promotional subscription price may apply only for the stated promotional period. The price applicable after the promotional period is clearly disclosed before enrollment.

  30. 30Product Changes

    ROOTÉ will not materially substitute a recurring product with a materially different product without appropriate disclosure. If a product becomes unavailable, ROOTÉ may pause the order, offer an alternative, issue a refund, or request customer approval for a substitute, depending on the circumstances. Where a change is material, customer consent is obtained where required by applicable law.

  31. 31Treatment Eligibility Changes

    Where a subscription includes a treatment subject to medical or regulatory eligibility, future fulfillment may depend on continued eligibility. ROOTÉ may pause or stop recurring fulfillment if medical approval expires, updated information indicates the treatment may no longer be appropriate, the prescription expires, applicable law changes, or a licensed provider determines that treatment should not continue. A subscription authorization does not override medical requirements.

  32. 32Prescription Renewals

    Where prescription treatment is involved, automatic commercial renewal does not automatically mean automatic prescription renewal. Any required medical review, updated questionnaire, prescription, or clinician approval must be completed as legally required before the relevant treatment is supplied.

  33. 33Stock and Regulatory Changes

    ROOTÉ may pause or cancel a subscription if a product becomes unavailable, discontinued, recalled, legally restricted, or unavailable in the customer's jurisdiction. ROOTÉ will not continue charging indefinitely for a product it cannot supply.

  34. 34Subscription Communications

    By subscribing, you agree to receive service-related communications necessary to manage the subscription, including renewal notices, payment confirmations, payment failures, shipment notifications, cancellation confirmations, safety communications, and program-related reminders. These are service communications and are separate from optional promotional marketing. Cancelling promotional marketing does not automatically cancel operational subscription communications.

  35. 35Marketing Consent Is Separate

    Enrollment in a ROOTÉ subscription does not automatically authorize unrelated promotional emails, SMS or WhatsApp messages where separate consent is legally required. Marketing preferences can be managed independently from the subscription.

  36. 36Cancellation Confirmation

    After a successful subscription cancellation, ROOTÉ provides a written confirmation by email and/or within the customer account where reasonably available or legally required. The confirmation should state that the subscription was cancelled, the effective date, whether any existing order remains in progress, and that future recurring charges will stop.

  37. 37No Cancellation Fee for Simply Stopping Future Renewal

    ROOTÉ does not charge a separate subscription-cancellation fee merely because a customer stops future recurring billing, unless a specific fee is lawfully applicable under a separately disclosed fixed-term commitment. For ordinary cancel-anytime recurring subscriptions, there is no subscription cancellation fee. This does not affect charges already lawfully incurred or obligations under a separately disclosed fixed-term commitment.

  38. 38Fixed-Term Commitments

    If ROOTÉ later offers a discounted fixed-term commitment — for example, a 12-month commitment paid monthly — that arrangement is clearly distinguished from a month-to-month cancel-anytime subscription. Before purchase, the customer is told whether cancellation stops future renewals only or whether a contractual minimum commitment applies. ROOTÉ does not use the phrase “cancel anytime” for a plan where the customer is financially committed to the full fixed period.

  39. 39Israeli Consumer Rights

    Israeli customers retain all mandatory rights provided by Israeli consumer law. Nothing in these Subscription Terms is intended to delay a statutory cancellation, permit charges after the legally effective termination date, require an unlawful cancellation fee, or remove any statutory right that cannot be waived. Israeli law specifically regulates disclosure and termination of ongoing transactions.

  40. 40California Consumer Rights

    Where California's Automatic Renewal Law applies, ROOTÉ will comply with its requirements concerning affirmative consent, disclosure of recurring terms, renewal reminders, fee-change notices, annual reminders, and easy cancellation. Customers who subscribe online must be able to cancel online as required by applicable California law.

  41. 41Changes to Subscription Terms

    ROOTÉ may update these Subscription Terms from time to time. A change to these general Terms does not automatically authorize ROOTÉ to materially change an agreed recurring price, billing frequency, or other material subscription term without the disclosure, notice or consent required by applicable law.
